UPDATE - Alert from the NAC: San Onofre Beach

September 2010, at least four citations were issued for nudity in early September. All four citations were reportedly issued by the same park ranger who is reportedly "stalking his quarry through field glasses or through the viewfinder of a camera from the top of a cliff overlooking the beach."

Citations for nudity at San Onofre are being issued under California Code of Regulations (CCR), Title 14, section 4322, a misdemeanor.

Background: The Director of California's Department of Parks and Recreation had announced that the application of a nearly 30-year state policy respecting traditional nude use in certain sections of state parks was to be revoked at San Onofre Beach. The Naturist Action Committee (NAC) filed a lawsuit in July 2008 to force the state to hold proper public hearings before any change in the current policy that allows nude use at San Onofre Beach.

NAC won at the Superior Court level in August 2008. The appellate court ruling favored DPR in June 2009, but the ruling was initially unpublished. At the request of DPR, the appellate ruling was published. NAC also requested the California Supreme Court to depublish. As reported October 22, 2009, The California Supreme Court has refused to hear Naturist Action Committee (NAC)’s appeal of the appellate court’s ruling in the San Onofre lawsuit, and also denied NAC’s request to de-publish.

The result of the published ruling is that DPR may issue citations for nudity under Title 14, Section 4322 of the California Code of Regulations AT ANY UNIT OF THE STATE PARK SYSTEM.
